Copyright registration

Copyright is copyrighted for literature, drama, music, works of art, audio recordings, etc. Copyright registration offers a number of rights that include copyright, social media, customization, and translation work. It is necessary to register for a copyright because it enables you to interact with the community, reproduce rights, convert and translate works.

Recently, there has been a sharp increase in the number of intellectual property registered in India as awareness of the laws of intellectual property has increased. Copyright registration happens to be one of the most important types of property protection systems.

Copyright registration is done in accordance with the regulations of the Copyright Act, 1957. Author’s creative work cannot be copied as no one is allowed to use the same without the permission of the author or creator. An author may charge others for using or altering his work. Copyright protection usually lasts 60 years.

Documents required to register copyright

Eligibility

Copyright registration can be obtained from any works related to text, drama, music, artwork, film, or audio recording. Copyright is granted mainly to three categories of work, and each category has its own separate rights under the copyright act.

  •       Original works of text, drama, music, and art include copyright for books, music, paintings, photographs, etc.
  •       Cinematography films are another copyright category that contains any visual recording activity in any media.
  •       Audio recording has a separate category under the copyright action that includes sound recording, regardless of the recording process or the way the sound is produced.

The process of copyright registration

An application for registration of a patent can be made on Form IV in the required form and fees. Whether published or not published work, it can be copyrighted. For a published work, three copies of the published work require submission and application.

While it is an unpublished work, a copy of the manuscript needs to be sent and a request to attach a copyright office stamp is proof that the work is registered.

Here is a step-by-step procedure for obtaining copyright registration in India:

Step: 1 – An application for copyright registration must be filed with the relevant forms for copyright.

Depending on the type of work, a separate copyrighted work may be required.

Step: 2 – The applicant needs to sign the forms, and the Attorney must submit the application under the name POA used.

Step: 3 – Diary Number will be issued once the request has been sent online.

Step: 4 – During the 30-day waiting period, the copyright inspector reviews the application for a potential dispute and any other conflicts.

Step: 5 – If there is a dispute, the notice will be issued, and the same must be compiled within 30 days from the date of issue of the notice. The inspector may call both sides for a hearing.

Step: 6 – After the difference has been removed or there is no objection, copyright is registered, and the Copyright Office will issue a registration certificate.

Eligibility for Copyright Protection

Generally, copyright protection is valid for 60 years. In the case of the original literary, dramatic, musical, and artistic works, 60 years are calculated next to the year of the author’s death.

While in the case of cinematographic films, audio recordings, photographs, post-mortem publications, anonymous or fake publications, government works, and the work of international organizations, 60 years are calculated from the date of publication.

Remedy in case of copyright infringement

Violation of the copyright of any work is a criminal offense and punishable under Section 63 of the Copyright Act. He could be imprisoned for six months with a small fine of Rs. 50,000.

Also, if a patent has already been or may be possible, then any police officer who is not under the rank of junior inspector, if satisfied, can take without permission, all copies of work and plates are used to make copies of work that are illegal.

Copyright owner rights
Copyright registration gives special rights to the copyright owner. A person may not copy or reproduce a work without the permission of the copyright owner.

The law allows the creator to use his piece of work the way he wants to use it. He can create any other things that come out of his first work. He can also use a different format based on his existing creations.

Trademark registration protects the brand name, motto logo while copyright protection is provided to works of text, music, videos, slogans, and art content.

Once copyright registration has been obtained it is valid for 60 years. If it is a script, a drama, a musical work 60-year verification is considered from the death of the author. But in the case of films, audio recordings, photos of the 60-year verification period are considered from the date of publication.

According to the Berne Convention, copyright acquired in India will determine the status of foreign workers and copyright protection is extended to countries that have signed the Berne Convention.

With the permission of the employer, copyright registration may be sold, transferred, gifted and franchise granted.
